These Terms of Service ("Terms") are a legally binding agreement between you ("you," "your," or "User") and Joswin P Satheesh, sole proprietor, operating under the laws of the Republic of India ("Arc," "we," "us," or "our"), governing your access to and use of the Arc mobile application and related services (collectively, the "Service").
By downloading, installing, accessing, or using the Service, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years of age to use the Service. If you are between 13 and the age of legal majority in your jurisdiction (typically 18), you may use the Service only with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. Arc is a paid subscription-based Android mobile application designed to support personal development through identity-first habit formation. Features currently include:
Important — what Arc is not: Arc is not a medical device, mental health treatment, therapy, counselling service, or substitute for professional advice of any kind (medical, mental health, financial, legal, or otherwise). The Service does not diagnose, treat, cure, or prevent any disease or condition. If you are experiencing a mental health crisis or medical emergency, contact a qualified professional or your local emergency services immediately. Arc allows you to begin and continue using the Service without creating a traditional account. We assign your device an anonymous identifier via Supabase Authentication. All your progress is tied to this identifier.
Because your anonymous account is bound to your device, you are responsible for:
We are not liable for losses caused by device loss, theft, factory reset, or failure to maintain device security.
You may reset your account at any time via Profile → Become someone else. This clears your identity, streak, action history, check-ins, and all related data. This action is permanent and cannot be undone. See our Privacy Policy for retention details.
You may maintain only one active anonymous identifier at a time per device. Sharing your subscription with others is prohibited.
Arc is a paid subscription service offered through the following plans:
Prices may vary by region and currency. Google Play converts USD prices to your local currency at checkout; the exact price applicable to your purchase will be displayed before you confirm the transaction. All prices are inclusive of applicable taxes where required by law (including GST in India).
All payments are processed by Google Play Billing. We do not receive, store, or process your payment card or UPI details. Your payment information is handled in accordance with Google Play's terms and Google's privacy policy.
Your subscription automatically renews at the end of each billing period (monthly or annually, depending on your plan) at the then-current subscription rate. Google Play will charge your selected payment method automatically. You will not receive a separate notice from us before each renewal charge.
To avoid renewal charges, you must cancel your subscription at least 24 hours before the renewal date.
You can cancel your subscription at any time through Google Play:
Cancellation takes effect at the end of your current billing period. You will continue to have access to the Service until that date. We do not charge cancellation fees.
Refunds for Arc subscriptions are handled exclusively through Google Play, in accordance with Google Play's refund policy: support.google.com/googleplay/answer/2479637. Google Play provides automatic refunds within 48 hours of purchase in most cases; outside that window, refund requests are evaluated by Google at its discretion.
We do not process refunds outside of Google Play. If you require additional assistance, email us at arc.app.contact@gmail.com and we will help facilitate your Google Play refund request where possible, though final approval rests with Google.
For EU/UK consumers: You may have a 14-day right of withdrawal under EU/UK consumer law. However, by accessing the Service immediately upon purchase, you may waive this right per applicable consumer protection law. Contact us within 14 days of purchase to exercise this right.
For Indian consumers: Refund requests are governed by the Consumer Protection Act 2019 to the extent applicable. Direct refund disputes to Google Play first; we will assist with grievance redressal where required.
We may offer free trials or promotional pricing from time to time. If you accept a free trial, you will be automatically converted to a paid subscription at the end of the trial period unless you cancel before the trial ends. Promotional pricing applies only for the specified period; the standard subscription price applies thereafter.
We may modify subscription prices at any time. If we change the price of your active subscription, we (via Google Play) will notify you at least 30 days in advance. The new price will apply only to renewals after the notice period; your current billing cycle will not be affected. If you do not agree to the new price, you may cancel before the next renewal.
You are responsible for any taxes, duties, or fees imposed by applicable governmental authorities on your purchase. Where Google Play collects such taxes at checkout, they are added to the displayed price.
Arc relies on a third-party AI service (currently Google Gemini) to generate personalised content, including daily micro-actions, weekly identity insights, milestone messages, and onboarding sentences. By using the Service, you acknowledge and agree to the following:
AI-generated content may be inaccurate, incomplete, biased, or inappropriate for your specific situation. You are solely responsible for evaluating any AI suggestion and determining its suitability for your circumstances. Do not follow AI-generated suggestions that seem unsafe, inappropriate, or contradictory to professional advice.
AI-generated content, and the Service generally, do not constitute professional advice of any kind. If actions relate to your physical health, mental health, finances, legal matters, or other significant areas of your life, consult a qualified professional before acting.
We make no representation, warranty, or guarantee that using the Service or following AI-generated suggestions will produce any specific result, improvement, or benefit. Personal development outcomes depend on factors outside our control.
If the AI provider is unavailable or rate-limited, the Service may show a generic, identity-anchored static action so your experience is not interrupted. These static fallbacks are not personalised and are clearly produced from a fixed pool.
As described in our Privacy Policy, data you provide that is sent to the AI provider (Google Gemini) is not used by Google to train their foundation models, per Google's Generative Language API terms.

We reserve the right to suspend or terminate your access immediately for violations.
The Service allows you to submit content such as your "why now" answer, check-in notes, identity label, and obstacle description ("User Content"). You retain ownership of your User Content.
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, create derivative works from, and use the User Content solely to operate, provide, and improve the Service. This license terminates when you delete the relevant User Content (e.g. via "Become someone else"), except to the extent that we have already shared it with service providers as needed to provide the Service or are required to retain it by law.
You represent that you have all necessary rights to submit your User Content, and that it does not violate any law or third-party right.
We do not actively monitor User Content, but we reserve the right to review, restrict, or remove any User Content that violates these Terms or applicable law.
The Service, including its design, source code, text, graphics, achievement glyphs, achievement names, rank names, identity card design, the Arc diamond mark, logos, and all related materials (collectively, "Arc IP"), is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws worldwide.
Subject to your compliance with these Terms and timely payment of subscription fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use.
You are encouraged to share screenshots and the in-app shareable cards — identity card, achievement reveals, weekly reports, and milestone moments — on social media and with friends. These shareable assets are designed to be shared as-is, with Arc branding intact.
You may not, without our prior written consent:
If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose without obligation to compensate you.
If you believe content in the Service infringes your copyright, send a notice to arc.app.contact@gmail.com containing: (a) your signature or electronic signature; (b) identification of the copyrighted work; (c) identification of the infringing material; (d) your contact information; (e) a statement of good-faith belief; (f) a statement of accuracy under penalty of perjury.
Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect your personal information. By using the Service, you agree to our data practices as described in the Privacy Policy.
We may modify, add features to, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation, except that if we permanently discontinue the entire Service we will provide reasonable advance notice and a pro-rata refund for any prepaid period.
You may stop using the Service at any time. You may reset your data via Profile → Become someone else, or uninstall the app. Anonymous data is removed within 30 days as described in our Privacy Policy.
We may suspend or terminate your access, with or without notice, if:

Jurisdictional exceptions: Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits liability that cannot be limited under applicable law, including liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited (including liability under Indian consumer protection law).
You agree to defend, indemnify, and hold harmless Arc and Joswin P Satheesh from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
We reserve the right to assume exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with our defense.
The Service integrates with and depends on third-party services including Google Play, Google Gemini, Firebase Cloud Messaging, Supabase, Expo, and Vercel. Your use of those services is subject to their respective terms. We are not responsible for third-party services, their availability, accuracy, security, or content.
These Terms are governed by the laws of the Republic of India, excluding its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before initiating any formal dispute, you and we agree to attempt to resolve the dispute informally by contacting arc.app.contact@gmail.com with a written notice describing the dispute. We will attempt to resolve the dispute in good faith within 60 days.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved through binding arbitration administered under the Arbitration and Conciliation Act, 1996 of India (as amended). The arbitration shall be conducted by a sole arbitrator mutually agreed upon by the parties, or in the absence of agreement, appointed in accordance with the Act. The seat and venue of arbitration shall be Kottayam, Kerala. The arbitration shall be conducted in English. The award of the arbitrator shall be final and binding.
Subject to the arbitration clause above, you and we agree that the courts of Kottayam, Kerala shall have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service that cannot be resolved through arbitration.
If you are a consumer in the European Union or United Kingdom, nothing in this Section 17 affects your rights to bring claims in your country of residence, as provided by mandatory consumer protection law. EU consumers may also use the online dispute resolution platform at ec.europa.eu/consumers/odr.
Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights.
Any claim arising out of or related to these Terms or the Service must be filed within one (1) year after the claim arose; otherwise, it is permanently barred, except where prohibited by applicable law.
We may modify these Terms at any time. When we make material changes:

The Service may be subject to export laws and regulations of India and other jurisdictions. You agree to comply with all applicable export and re-export restrictions.
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, acts of war, civil unrest, government actions, labour disputes, internet or infrastructure failures, or pandemics.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service, superseding any prior agreements.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
Our failure to enforce any right or provision is not a waiver of that right or provision.
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction, including to a successor entity.
These Terms do not confer rights on any third party, except as expressly provided.

Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, limitation of liability, and dispute resolution.
